Terms and Conditions for Compassion Cremation

1. Introduction and Acceptance of Terms

4.1 Service Availability

Services are subject to availability and geographic limitations. Not all Services may be available in all locations. We reserve the right to refuse service for any lawful reason.

Certain Services may require coordination with third-party providers (such as medical examiners, coroners, or certified crematories). While we exercise reasonable care in selecting third-party providers, we are not responsible for delays or issues caused by third parties beyond our control.

5. Products

We offer various Products for purchase through our Website, including urns, memorial jewelry, keepsakes, and related memorial items.

5.1 Product Descriptions

We attempt to describe and display our Products as accurately as possible. However, we do not warrant that Product descriptions, images, colors, or other content are accurate, complete, reliable, current, or error-free. Products may vary slightly from their images or descriptions.

5.2 Product Availability

All Products are subject to availability. We reserve the right to discontinue any Product at any time without notice. If a Product becomes unavailable after you place an order, we will notify you and offer a suitable alternative or full refund.

6. Ordering Process

6.1 Placing Orders

When you place an order through our Website, you are making an offer to purchase Services or Products under these Terms. All orders are subject to acceptance by Compassion Cremation. We reserve the right to refuse or cancel any order for any lawful reason, including but not limited to:

For cremation and memorial Services, a separate written service contract will be executed. In the event of any conflict between these Terms and a signed service contract, the service contract shall prevail.

7. Pricing

7.1 Price Accuracy

We make every effort to ensure pricing accuracy on our Website. However, errors may occur. If we discover a pricing error after you have placed an order, we will notify you and give you the option to:

  • Cancel the order and receive a full refund

9. Shipping and Delivery (Products)

9.1 Shipping Methods

Products will be shipped via methods specified at checkout. Shipping costs and estimated delivery times will be displayed before you complete your purchase.

9.2 Delivery Timeline

Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, weather, customs (for international orders), or other factors beyond our control.

9.3 Risk of Loss

Risk of loss and title for Products pass to you upon delivery to the shipping carrier.

9.4 Delivery Issues

You must inspect Products upon delivery and notify us within 48 hours of any damage, defects, or shipping errors. Failure to notify us within this timeframe may limit your remedies.

10. Service Delivery Timeline

10.1 Service Commencement

Services will commence according to the timeline specified in your service contract. Due to the nature of cremation services, certain legal and regulatory requirements may affect timing.

10.2 Delays

We will make reasonable efforts to provide Services within the agreed timeframe. However, we are not liable for delays caused by:

  • Legal or regulatory requirements
  • Medical examiner or coroner requirements
  • Third-party service provider delays
  • Acts of God, natural disasters, or other force majeure events
  • Circumstances beyond our reasonable control

11. Cancellation and Refund Policy

11.1 Service Cancellations and Refunds

IMPORTANT: Once a service contract has been signed and accepted by Compassion Cremation, no refunds will be issued for Services.

This no-refund policy exists because:

  • We immediately begin coordinating and scheduling resources upon contract execution
  • Third-party services and crematory facilities are reserved on your behalf
  • Legal and regulatory processes are initiated
  • The time-sensitive nature of cremation services requires immediate action

Pre-Contract Cancellation: If you wish to cancel before signing a service contract, you may do so without penalty. Any deposits paid will be fully refunded.

Post-Contract Cancellation: Once a service contract is signed, you remain obligated to pay all fees specified in the contract, regardless of whether Services have been performed. This is a firm policy with no exceptions.

11.2 Product Returns and Refunds

11.2.1 Standard Products For Products (urns, memorial items, keepsakes):

  • You may return unused Products within 30 days of delivery for a refund
  • Products must be in original, unopened packaging and in resalable condition
  • You are responsible for return shipping costs unless the Product was defective or we shipped the wrong item
  • Refunds will be issued to your original payment method within 10 business days of receiving the returned Product
  • Shipping charges are non-refundable except in cases of our error or defective Products

11.2.2 Personalized or Custom Products Products that have been personalized, engraved, or custom-made to your specifications cannot be returned or refunded unless defective or we made an error in production.

11.2.3 Defective Products If you receive a defective Product, contact us within 48 hours of delivery. We will, at our discretion, replace the Product or issue a full refund including shipping costs.

11.3 How to Request a Return
